Welcome to Travelhapp!

Travelhapp.com is a website for solo travelers in Colombia. It provides tips and inspiration for traveling alone in Colombia and gives visibility to interesting tours and experiences offered by small local tourism and cultural providers in Colombia. 

The Travelhapp.com website is accompanied by a private Facebook Group, where solo travelers can share experiences and team up for activities. The focus is on meaningful, sustainable, and responsible travel.

By using our website you agree to our General Terms and Conditions (GTC) which are described here below.

These Terms apply to Consumers, i.e. Travelers. If you are a provider of tourism or cultural services, please refer to the Terms and Conditions for Providers.

General

Travelhapp is operated by Travelhapp S.A.S., a company legally registered in the Chamber of Commerce of Bogota, Colombia, on January 8, 2020, under mercantile registration number 03200567 and NIT 901353418-8.

These Terms of Use (“Terms”) govern the use of Travelhapp’s website and Facebook group (in addition to Facebook’s policies). By using our website and services, you agree to comply with these Terms and our Privacy Policy. If you do not accept these Terms, please refrain from using the Travelhapp website.

 

Scope of Terms

These Terms apply to all visitors and users of Travelhapp. As our services evolve, we may update the Terms from time to time. We will notify you of any significant changes, and continued use of our website indicates acceptance of the updated Terms.

 

Definitions

  • Travelhapp, us, we, our, the company: These terms refer to Travelhapp S.A.S..

  • Users:

    • Consumers (i.e. travelers, private individuals), you, your

    • Providers (i.e. tourism and cultural providers – tour guides, tour operators, artists, etc).

  • Travelhapp Service(s), our Service(s): the Travelhapp website and its features, as well as directly related services like our customer support and our Facebook Group

2.1 Eligibility

By using Travelhapp.com and/or our Facebook group, you confirm that:

  • You are at least 18 years old.
  • You respect women and all other genders, and you support diversity and inclusion.
  • You practice and support sustainable and responsible travel, respecting people, cultures, and the environment. The promotion of drug use, exploitation, or disrespect for local cultures will not be tolerated.
 

2.2 Safety

Please remember that our Facebook group serves as a community space for communication and interaction, and Travelhapp cannot take responsibility for the behavior of its users.

  • You are solely responsible for determining the identity and suitability of others with whom you may interact, on or off the website or Facebook group. Travelhapp does not investigate or verify any member’s identity, background, conduct, morality, or the information shared by members.
  • Travelhapp is not responsible for the conduct of any user on or off of the Service and makes no representations or warranties regarding user interactions. You agree to use caution in all interactions with other users, including any interactions beyond the Travelhapp website and Facebook group, or if meeting in person.
  • We encourage you to review Travelhapp’s Safety Tips before engaging with other users.
 

2.3 Community Conduct and Content Sharing

  • When interacting on the Travelhapp.com website or in our Facebook group please be respectful and kind. Refer to our Facebook group rules for detailed information regarding interaction in the group.
  • Information you provide on the website or in the Facebook group, including comments and other interactions, must be accurate and truthful to the best of your knowledge. You agree not to spread false information and to perform fact-checks where possible.
  • You agree not to use the Travelhapp website or associated Facebook group for self-promotion, direct advertising, or any financial transactions with other users.
  • For our Facebook group, our Terms and Conditions apply in addition to Facebook’s group and community standards.

Travelhapp reserves the right to remove any content that violates our terms or community standards.

3. Warranties and liability

3.1 Liability for Tours and Experiences

  • Travelhapp’s Role: The Travelhapp website provides informative and inspirational articles and curated recommendations regarding local guides, experiences and tours in Colombia, as well as a community Facebook group. We do not organize or oversee tours or activities conducted by other providers. Travelhapp is not a travel agency, booking service, tour reseller, agent, or broker.
  • Your Responsibility: Any tours or experiences promoted on Travelhapp do not constitute binding offers. You are responsible for verifying all details, including availability, pricing, and terms, and for arranging bookings directly with providers. Travelhapp does not manage or guarantee the availability, quality, or pricing of any third-party listings and is not liable for any agreements, interactions, disputes, or transactions between you and others.
 

3.2 Liability for Third-Party Content and External Links

Travelhapp contains links to third-party websites and resources. We do not control these sites and are not liable for their availability, accuracy, or content. Your interactions with third-party sites are governed by their terms, and we disclaim any responsibility for their services, terms, or actions.

 

3.3 Service Availability, Quality, and Security

  • “As-Is” Basis: Travelhapp’s website and content are provided “as is” and “as available.” We make no warranties as to service availability, quality, or security.
  • No Guarantee of Continuous Access: Travelhapp is not liable for temporary service unavailability due to technical issues, maintenance, or other disruptions.
 

3.4 Limitation of Liability

Travelhapp is not liable for any direct or indirect damages resulting from your use or inability to use the Service, interactions with third-party content or other users, or unauthorized access to your content. You agree to hold Travelhapp harmless from any claims arising from your use of the website or Facebook group.

Travelhapp reserves the right to modify or discontinue its Services at any time. 

We may also update these Terms and Conditions. Any changes will be reflected on the website, and we will make reasonable efforts to inform you about significant updates. You can always refer to the most current version of these Terms.

5. Privacy Policy and Data Protection

6. Content

6.1 User Content and Travelhapp Content

Travelhapp allows users to comment on website articles, and to create, upload, post, send and receive content in its associated Facebook group, such as text, photos, audio, video, or other materials and information (“User Content”).

Travellhapp allows its users to access and view such User Content, as well as any content that Travelhapp itself makes available, including proprietary Travelhapp content and any content licensed or authorised for use by or through Travelhapp from a third party (“Travelhapp Content”).

 

6.2 Content Policies

You may not post any content that:

  • Is false, misleading, defamatory, or offensive;
  • Promotes discrimination, hate speech, or violence;
  • Violates others’ rights, including intellectual property or privacy rights;
  • Promotes illegal activities, sexual exploitation, or harm to minors.
 
For content shared within the private Facebook group, Facebook’s policies apply.

We reserve the right to remove or disable access to content that violates these guidelines, including comments, at our sole discretion.
 

6.3 Reporting Infringement

If you believe that any content posted on Travelhapp, including comments, violates your rights or the Terms, please notify us by contacting support@travelhapp.com.

7. Governing Law & Arbitration

These Terms and the entire legal relationship between Travelhapp and you are governed by Colombian law. The court of jurisdiction for all disputes arising from these Terms is the arbitration center of the Bogotá Chamber of Commerce. However, as a consumer, you may be entitled to the protection of mandatory laws in the country where you are located or habitually reside.

8. Final provisions

8.1 Other Agreements and Form

There are no verbal agreements in place. Any modifications, subsequent additions, or ancillary agreements shall be invalid unless made in writing. This also applies to any waiver of this written form requirement.

 

8.2 Severability Clause

Should any provision of these Terms and Conditions be wholly or partially invalid, the remaining provisions shall remain unaffected.

 

8.3 Successors and Assigns

These Terms and Conditions shall be binding upon and benefit the parties and their successors and permitted assigns.
